Welcome to BookMyShooter. By accessing or using our website, mobile application, or services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Services.

These Terms constitute a legally binding agreement between you and BookMyShooter ("we," "us," or "our"). We reserve the right to modify these Terms at any time, and such modifications will be effective immediately upon posting.

2. User Accounts

2.1 Account Creation

To use certain features of our Services, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security of your password and account
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use

2.2 Account Types

We offer two types of accounts: Client accounts and Photographer accounts. Photographers must provide additional verification and portfolio information to offer services on our platform.

2.3 Account Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion.

3. User Conduct

You agree not to:

• Violate any applicable laws or regulations
• Infringe on intellectual property rights of others
• Upload or transmit viruses, malware, or harmful code
• Harass, abuse, or harm other users
• Post false, misleading, or fraudulent content
• Attempt to gain unauthorized access to our systems
• Use automated systems to access the Services
• Circumvent any security features or restrictions
• Engage in any activity that interferes with the Services

4. Bookings and Payments

4.1 Booking Process

When you book a photographer through our platform, you are entering into a direct agreement with that photographer. BookMyShooter acts as a marketplace to facilitate these transactions.

4.2 Payment Terms

All payments are processed through our secure payment system. By making a booking, you agree to pay all applicable fees, including service fees and any applicable taxes.

4.3 Cancellations and Refunds

Cancellation and refund policies are set by individual photographers. Please review the photographer's cancellation policy before booking. BookMyShooter service fees are generally non-refundable.

4.4 Disputes

In the event of a dispute between a client and photographer, we encourage direct communication to resolve the issue. BookMyShooter may, at its discretion, assist in mediating disputes but is not obligated to do so.

5. Content and Intellectual Property

5.1 User Content

You retain ownership of any content you post on our platform ("User Content"). By posting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such content in connection with our Services.

5.2 Photographer Portfolios

Photographers are responsible for ensuring they have the right to use all images in their portfolios. By uploading portfolio images, photographers represent that they own or have permission to use such images.

5.3 Our Intellectual Property

All content on our platform, including text, graphics, logos, and software, is the property of BookMyShooter or its licensors and is protected by copyright, trademark, and other intellectual property laws.

6. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices.

7. Disclaimers and Limitations of Liability

7.1 Service Disclaimer

Our Services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that our Services will be uninterrupted, secure, or error-free.

7.2 Third-Party Services

BookMyShooter is a marketplace platform. We do not employ photographers and are not responsible for the quality, safety, or legality of services provided by photographers. We do not guarantee the accuracy of photographer profiles or portfolio content.

7.3 Limitation of Liability

To the maximum extent permitted by law, BookMyShooter shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.

8. Indemnification

You agree to indemnify, defend, and hold harmless BookMyShooter and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your access to or use of our Services, your violation of these Terms, or your violation of any rights of another party.

9. Dispute Resolution

9.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

9.2 Arbitration

Any dispute arising out of or relating to these Terms or our Services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, rather than in court.

10. General Provisions

10.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and BookMyShooter regarding our Services.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

10.4 Assignment
